How does one provide a rental agreement between family? (Answers: 3) (Comments: 0)

I am looking into applying for financial assistance in Canada but they are asking me to provide them with my rental agreement. I pay rent monthly to my mom that I live with which helps to pay the bills for her. But we never had any such rental agreement. I paid her $400-$500 a month and if I couldn't pay that to her I paid what I could. So what exactly do I do here to show them of this expense I have? There is no rental agreement between us that is written just verbal. Any advice would be appreciated.

We live in a complex of duplex's in Oregon which have just changed ownership. Since changing ownership there have been some changes. Our rent has increased, and we are now having to pay for our own water and sewer. We don't have a problem with this as long as it is done correctly. However, we got our first water bill from the landlord which stated we owe $51.20 for 3 weeks of water and sewer usage. We have a household of 3 people, 2 adults and 1 2 year old. We do everything in our power to conserve water to the point of only showering once or twice a week, doing laundry once a week, and waiting to do the dishes till the sink is full. We just got a notice from the landlord stating that the water bill we received was for ONE week of water and sewer usage when the previous statement stated THREE weeks of usage. A lot of their notices have been incorrect, it appears that it is due to typos, but when it comes to written statements from landlords, it is never good to have inconsistencies. Our property manager has stated bluntly that he does not care what the law says and that he does whatever he wants. In previous conversations he has mentioned that he is in the middle of 2 court cases defending his actions (one of which was an assault on a tenant). He has also mentioned to my girlfriend one of the reasons he doesn't have money to make repairs is because he has "a sweet spot for cocaine". Not only that, but he tried telling her that she needed to give me more blow jobs. This is not the proper way to act as a property owner!! We have been screwed by property managers in the passed, and I want to make sure that are prepared to act correctly when the time comes to defend our rights as tenants. One of those things that I have been worried about is when we do decide to leave (we are moving in a month or two) that we don't get reamed on our deposit just so they can make renovations. So, when property ownership changes, does a new rental agreement need to be signed, or is the current agreement carried over to the new property owner. Also, any links or information on how I can protect myself would be appreciated. We have learned from our past experiences to save all documents between us and our property managers. What sort of rental agreement should be drawn up when I'm renting rooms in a subletting situation or a situation where the person I'm renting from owns the house/condo/whatever. I want to move out of my apartment and get a home that is lease-to-own. If I do this, will I be able to rent out the two other bedrooms? If I do rent the other bedrooms, are the other people partial owners or are they just renters? And do I set up a rental agreement between myself and the renters or does the owner of the property set up the rental agreement between himself and the renters? Thanks.

All landlords should tenant screen potential consumers. I do believe if a difficult financial situation arises and you have been in good standing with the landlord for years, then they should be a little more leanent.

A landlord credit check is something I use to help me make my decisions on prospective tenants. I understand people might have credit problems, but I have a decision to make and I need to make the best decision which includes, "can this person afford to live here and be a good tenant". The landlord credit check provides a very good outline of this person and I recommend to include this at all times.

When dealing with tenants and a tenant screen you have to do everything by the book . If their lease says there is a penalty for late payment , enforce it . In most cases verbal agreements are very hard to enforce . It is always better to have everything on paper .

Although I personally have owned rentals in 4 different states, I am more experienced in New Jersey, so I can speak from that vantage point. In the state of New Jersey, the last time I checked, the tenant has 30 days to retrieve any items they left behind. However with that said, it is not 30 days from the day they move out, it is 30 days from the date you file the paperwork that the tenant moved out.

In Trenton, once the 30 days has lapsed, you can basically do whatever you want with it. I normally donate it to charity, and that is the God's honest truth. If I kept all the stuff left behind by tenants, I would have no room in my own house. I know some landlords sell things on eBay, etc, but I just don't have the time for that. You'll have to check to see what your area allows and then decide what is right for you.
